Investigators: Flanders man using residential property for three businesses

An owner who, in Flanders, in March and July was slapped with summonses for operating a business of a residential building was cited again last Thursday, this time for an illegal apartment or other building code violations on the same property, Southampton City officials said.

Officials also said the owner, Frank Fisher, 32, of Flanders, to $ 5,710 in unpaid taxes on the land.

Mr. Fisher did not return telephone messages seeking comment for this article.

David Betts, chief investigator for the department of Southampton City code enforcement, said the two previous raids found three companies operating in the field of one hectare 52 Priscilla Avenue, sanitation Go Green - who earlier this year has been legal difficulties in the town of Southold recycling issues - Fisher landscaping and a masonry company.

"There was garbage trucks parked overnight, and hundreds of garbage containers of the company were stored there," said Betts July 28 raid. "The property is zoned residential and the used commercially. It's illegal."

"The investigation was in response to neighborhood complaints," said Betts. "We issued violations in March, and we did another inspection and found that he was still in violation."

Mr. Betts said Fisher has a clean part of the property since March, when several large roll-off containers were stored.These containers have been removed, but the property was still used commercially to store the material of the three companies, he said.

Thursday morning, the application code is returned to 52 Priscilla Avenue with a search warrant - they were able to search inside the house - and found that the basement had been illegally converted into a separate apartment with three beds, a kitchen and a bathroom, according to city officials.

There was no smoke or carbon monoxide in the basement and the ceiling height is 6 feet, 9 inches, two violations of the New York State Uniform Fire Prevention and Building Code, have officials said.

In addition, officials said, many changes were made to the building without a building permit or lease. The allegedly illegal alterations included the removal of heating, change the plumbing and electrical wiring, and cut into the foundation to create an emergency exit window.
