Kleen Energy Explosion Lawsuits Headed To Mediation
(Source: The Hartford Courant, Connecticut) By Josh Kovner, The Hartford Courant, Conn.June 27--Lawyers for the dead and injured in the Kleen Energy power-plant explosion have agreed to attempt to settle a string of lawsuits seeking millions of dollars from the Middletown plant's owners, builders, and contractors.
The first of the mediation sessions will occur July 18-21 in Superior Court in Middletown. Judge Robert L. Holzberg, who has a reputation as a skilled mediator, will preside. There were more than 20 lawyers in the room when Holzberg laid down the ground rules for both sides in a meeting earlier this month.
The Feb. 7, 2010, natural-gas explosion killed six workers and injured several dozen. Federal work-safety regulators later issued over $16 million in fines and identified more than 100 violations at the plant. The facility has been rebuilt and is testing its turbines in anticipation of beginning to sell electricity this summer.
A mass settlement in the Kleen Energy case would rival those of the priest-abuse scandals and the L'Ambiance Plaza collapse in Bridgeport, which killed 28 people in April 1987. The 44 L'Ambiance Plaza cases were grouped and settled for $43 million.
At least 29 state lawsuits involving more than 60 clients have been filed in the Kleen Energy case. Two federal lawsuits have also been filed; they would not be part of the state mediation effort.
"We're entering into this in good faith," said lawyer Robert Reardon of New London, who represents five injured workers and 31 workers who lost substantial earnings as a result of the blast. "The goal would be to accomplish a mass settlement."
O&G Industries of Torrington, the general contractor and minority owner of the $1 billion power plant, has denied any wrongdoing.
The mediation is "something both sides are showing a great deal of good faith in, to sit down this early in cases of this magnitude to try to reach a speedy resolution," said Jeffrey Blueweiss, a Shelton lawyer who represents O&G. There's an incentive to settle the cases, he said, "because later there will be a tremendous amount of litigation."
The plant's majority owner is Energy Investors Funds, or EIF, through a Connecticut corporation called Kleen Energy Systems LLC. Attorney Austin McGuigan, whose Hartford firm represents Kleen Energy, was not immediately available Friday.
Reardon said both sides have agreed not to discuss the progress of the mediation effort with the media once the sessions start.

Q: How did you get started in locksmithing?
A: A friend in Salt Lake got my into it. Went from SLC to Park City/Heber, UT to Evanston, Wyoming.

A: Pick locks, get into cars legally, re-key, and work on safe are a few of the job details. Being licenced and bonded is essential. I have to re-certify for both regularly.
